Krugman is innocent

During the Iraq war, I was a big fan of Paul Krugman's trenchant columns. It was a case in which my libertarian values dovetailed nicely with Krugman's liberalism.

For a while, his email address was on my list for a journalistic circular I put out. Then one day I suppose I annoyed him by writing something that included his name. It was about the percentage of Jewish columnists writing for his paper, The New York Times. I did not cast aspersions, but I thought it an interesting factoid. In any case, Krugman immediately hit unsubscribe. I suppose he thought I was being racist.

Some months ago I noticed him sitting alone at a cafe in Princeton, where he is an economics professor. He looked rather glum, and so I did not approach him to say hello. He left without speaking to anyone in the noisy crowd.

In recent years, I have paid little heed to Krugman, realizing that he is just another outraged liberal who spills a lot of ink bashing Donald Trump. You know: ho hum.

So that's about all I know about Krugman.

On that basis, I would like to very strongly lend my support for his presumed innocence on any child pornography charges that might be contemplated.

Krugman says that his internet address was hacked by someone downloading child pornography, associating his address with such activity.  

Krugman  acknowledged Wednesday on Twitter that his IP address had been "compromised," spurring him to take security measures.

"Well, I’m on the phone with my computer security service, and as I understand it someone compromised my IP address and is using it to download child pornography," Krugman wrote in the tweet. "I might just be a random target. But this could be an attempt to Qanon me. It’s an ugly world out there."

"Qanon" refers to a group of people who in recent years have spread incriminating myths against many high-profile Democrats on social media.

I would like to point out that I have -- through a number of accounts and IP addresses -- been a regular target of hackers who do all sorts of bizarre things to make my work more difficult. Evidently my political expressions attract resentful persons whose means of dealing with contrary views is to attack the messenger. I suppose they are not terribly articulate and can't think of much else to do.

So I can well believe that Krugman has attracted vicious hackers deploying their tawdry malwares.

Some people think they are being funny when they respond with wisecracks impugning Krugman's credibility. What I say is that unless he is convicted in a court of law, he is innocent. Period. (And even in the event of conviction, one can never be sure -- especially in highly charged political situations -- that a frame-up did not occur.)

Bloomberg a hardliner on abortion

Michael R. Bloomberg, the New York media tycoon who is running for president, has a no-holds barred attitude on abortion, denying that unborn children have a fundamental right to life.

Bloomberg, an erstwhile Republican now positioning himself as a Democrat, is quoted by the Los Angeles Times as saying, “Reproductive choice is a fundamental human right, and we can never take it for granted,” adding, “On this issue, you’re either with us or against us.”

Such stridency is likely to affect his presidential bid, sharply curtailing the Republican vote he hopes to draw. Similarly, many Republicans will look askance at his well-financed campaign to roll back the Second Amendment protections that red states grant gun owners, once President Trump begins to hammer on that theme.

On the other hand, Bloomberg could well pick up much of the support the archly pro-abortion Hillary Clinton enjoyed in her campaign for the presidency, but whether he will satisfy feminists in general is another matter.

Bloomberg's media company has announced that it will continue coverage of Trump but won't cover Bloomberg or other Democratic presidential candidates, this sparing it from having to run anything negative about the boss.

On averting war with Iran

Wed. Jan. 8 -- Happy that President Trump showed restraint in response to the Iranian missile strike, seeimingly regarding it as a face-saving measure that we could live with.

The White House can make a plausible case that it can respond with massive force against Iran without a war declaration. It can point out that Iran's not-so-covert involvement in the Iraq war means that the congressional authorization for the use of force that applied to Iraq also applies to Iran.

Even so, now is the time for a very calculating, rational response to the Iranian missile strike.

What to do?

¶ At some point soon, change the administration's image by asking the resignation of the President's ultra-hawkish adviser, Mike Pompeo, from the State Dept.

¶ Democrats and Republicans should resolve to work together -- not butting heads for political fanfare -- to help resolve the crisis in a rational manner. Perhaps they could join a special presidential-legislative advisory council that would work with the White House domestically and internationally.

¶ World leaders with experience and an interest in the region should attempt to help bring about a workable resolution. Even though the UK and Russia are none too fond of each other, it makes sense for Boris Johnson and Vladimir Putin to put their heads together to prevent a bad situation from flaring into something much worse.

¶ Something that could be discussed is a revision in the make-up of the Iranian government. Though President Trump has said the United States would not seek regime change, all bets are off following the escalation by an unstable, irrational element in Tehran. That group needs to step aside, just as Pompeo and his circle also needs to stand down.

¶ Some form of retaliation is inevitable. But, does it have to be through the use of more hot-war tactics? Perhaps a U.S. naval quarantine of Iranian sea and air ports might work better than a rain of hellfire from the sky. Though hellfire from the sky has a glamorous appeal to the immature, is it really the most rational response?

Iran is facing the annihilation of its oil production capacity. Sen. Lindsey Graham, after speaking with Trump, tonight used the airwaves to warn Iranian leaders that their country's fate was in their hands, that if they "continue this crap, you will wake up without an oil industry." He termed tonight's missile attack "an act of war."

Graham told Sean Hannity of Fox News that Iran is a terror-backing state that is intent on killing every Jew in Israel, but that Trump is "a new sheriff in town" who understands the Iranian menace.

Despite Graham's tough rhetoric, it is in everyone's interest to tone down the heated language and come up with a rational solution.

Fox News' Bret Baier noted that Iran avoided striking an Iraq base holding a large number of U.S. military, but speculated that this was because of its location in a Shia Muslim area. The two bases that were struck, he said, were in Sunni Muslim and Kurdish areas. Sunnis and Kurds are antagonistic to the Shia regime in Iran.

¶ Politically, war is not in Trump's interests. Americans soon tire of the bloodshed. Wartime presidents have about a 50/50 chance of re-election.

Similarly, the leadership of Iran -- excepting perhaps Mr. Biggie Ali Khamenei -- gains little from war other than a life in deep bunkers. By keeping a war going, Khamenei can continue to grasp the levers of power rather than being forced out by rivals who are no longer oppressed by his late enforcer, Qasem Soleimani. But does an 80-year-old supreme leader really have the desire or capacity to continue such a very dangerous course? Or are hotheads even now edging him aside?

GOP split over when to launch trial proceedings

The Senate majority leader reiterated his decision to forbid the launch of a Senate trial of charges against President Trump without the assent of the House speaker.

Sen. Mitch McConnell, R-Ky., is opposing a group of Republicans who are pressing for a change in Senate rules so that the impeachment trial proceeding can begin without Nancy Pelosi, R-Ca., sending the two impeachment articles from the House to the Senate.

Under a proposal from that group, the Senate could dismiss the accusations if Pelosi declines to act within 25 Congressional working days. The head of the Senate Judiciary Committee, Lindsey Graham, R-S.C., has voiced a similar idea, though he did not join in that resolution.

But McConnell, according to Fox News today, repeated his assertion that the rules require him to wait for Pelosi.

McConnell said he has enough votes -- at least 51 -- to proceed with the trial without calling witnesses beforehand, though witnesses could be summoned after senators have heard the House case -- assuming Pelosi budges (which is not a safe assumption, according to some senators).

Democrats are demanding that witnesses be called to the Senate to compensate for them not having testified in the House, although the House refused to await court decisions before passing the articles. Republicans counter that the Democrats acted in bad faith by moving the articles before courts could rule on the President's invocation of the executive privilege.

McConnell has said he suspects Pelosi is stalling because she wants to fish up more "talking points" to use against Trump.

Not only Republicans are facing party fissures. Even some Senate Democrats have indicated that they are ready for the articles to come to the chamber, CNN reports. For example, Sen. Doug Jones of Alabama, R-Al., who is up for re-election in 2020, suggested that he is ready to begin the trial. "I'm hoping they will come over here soon," Jones told CNN, speaking of the House articles. "I think most people are ready to get moving on this."

The Democratic senator said "what concerns me more" is the GOP refusal to call witnesses before hearing the House case, arguing "that we need to able to fill in gaps" left by the House's refusal to litigate the claim of executive privilege.

Graham told Fox News Sunday that he is urging McConnell, whom he praised, to consider a change of Senate rules that would permit Graham's committee to get moving on the trial right away, with the goal of having it completed before the end of the month. Graham said the Senate would not permit Pelosi to dictate how the Senate trial is conducted.

Graham said the Senate would follow the model used in the impeachment trial of President Bill Clinton. Hearings would be held; the House -- if it chooses to -- could present its case; and then the Senate will decide whether to call witnesses. But, if the House refuses to act, the Senate would formally dismiss the case, he added.

Graham slammed the impeachment case as weak, and said Democrats may be holding the articles in order to try to add another article to strengthen their claims. He decried the "obstruction of Congress" article as specious, saying that the Democrats refused to await a court outcome of Trump's claim of executive privilege. Graham said the impeachment case, and Pelosi's attempt to stall it, are "dangerous to the presidency." The founding fathers "never imagined" that a House leader would behave in such a manner, he said.

Another call for a rules change came from Sen. Josh Hawley, R-Mo., who, along with a group of Republican colleagues, on Monday introduced a change in rules that would allow the Senate to dismiss articles of impeachment against Trump for lack of prosecution by the House, as House Speaker Nancy Pelosi delays sending the case for trial.

Joining Hawley were Rick Scott of Florida, Mike Braun of Indiana, Marsha Blackburn of Tennessee, Ted Cruz of Texas, Steve Daines of Montana, John Barrasso of Wyoming; Tom Cotton of Arkansas, Joni Ernst of Iowa, David Perdue of Georgia and Jim Inhofe of Oklahoma. [No word on why Graham did not join the measure.]

Hawley said, “If Speaker Pelosi is afraid to try her case, the articles should be dismissed for failure to prosecute and Congress should get back to doing the people’s business.”

Hawley’s resolution would allow the Senate to dismiss the articles of impeachment for lack of prosecution, once the House has withheld articles for 25 calendar days or more. Under the proposed rule, any senator would be able to move to dismiss the articles once the time period has elapsed. That motion would then be voted upon by the full Senate.

Thus far, Pelosi has held the articles of impeachment for 19 days, apparently leaving only six congressional work days remaining.  

“After three years of searching for a reason to impeach this president, Democrats in the House cannot seem to find the time to send over the articles of impeachment,” Blackburn said in a statement. “If House Democrats are so confident in their findings, they ought to have no problem sending the articles over within a 25-day deadline.”

“Nancy Pelosi is attempting to obstruct a Senate trial. That's all there is to it,” Hawley, who serves with Graham on the Senate Judiciary Committee, said.

“The Constitution says that the Senate is the one that will have the trial. It says the trial will follow the impeachment,” Hawley noted. “Now she’s trying to prevent us in a trial. She’s trying to obstruct it, she’s trying to upend the Constitution.”

On Friday, McConnell panned Pelosi's blockade of the articles.

"The same people who spent weeks screaming that impeachment was so urgent," McConnell said, have "now decided it could wait indefinitely while they check the political winds and look for some new talking points."

Hawley warned, "We could be sitting here in October of this year and Nancy Pelosi could still be sitting on the articles, or when the President gets re-elected, as I believe he will, we could see her still holding on to the articles to try and obstruct a second term. I mean, if the Senate doesn't act, then there’s no end in sight.”

Chapter V Legal Liability
